These Terms and Conditions ("Terms") govern your access to and use of Tabely, a digital menu platform owned and operated by ClickMedia Solutions. By accessing or using Tabely, you agree to be bound by these Terms. If you do not agree, please do not use the service.

1. Acceptance of Terms

By signing up, accessing, or using Tabely in any manner, you agree to comply with these Terms and all applicable Nigerian laws and regulations, including but not limited to the Nigeria Data Protection Regulation (NDPR), the Cybercrimes Act 2015, and the Consumer Protection Framework.

2. Eligibility

You must be at least 18 years old to use Tabely. By using the service, you confirm that you meet this requirement and are capable of entering into a legally binding agreement under Nigerian law.

3. Description of Service

Tabely provides a platform for restaurants, bars, and hotels to create, manage, and display their digital menus via QR codes. The platform includes features such as online ordering, analytics, team management, lead generation, and more.

4. User Responsibilities

  • Maintain accurate information on your menu listings.
  • Comply with all applicable health, safety, and food labeling regulations.
  • Refrain from uploading harmful, misleading, or offensive content.
  • Keep your account credentials secure and confidential.

5. Intellectual Property

All content, branding, and technology related to Tabely remain the intellectual property of ClickMedia Solutions. You retain ownership of the content you upload but grant us a non-exclusive, royalty-free license to display and distribute your menu as necessary for platform functionality.

6. Data Privacy

We collect limited customer data such as order history and contact details. This data is processed in compliance with the Nigeria Data Protection Regulation (NDPR). You may only use customer data obtained through Tabely for order fulfilment or business follow-up. You may not sell or misuse this information.

7. Payments

Tabely is currently free to use. Should this change, users will be notified in advance and given the option to agree to new terms or discontinue usage.

8. Third-Party Links

Tabely may contain links to external sites, such as your social media pages or payment processors. We are not responsible for the content or privacy practices of these third-party services.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, abuse the platform, or engage in illegal activity. You may also delete your account at any time by contacting support.

10. Limitation of Liability

Tabely is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted service. To the maximum extent permitted by Nigerian law, ClickMedia Solutions shall not be liable for indirect, incidental, or consequential damages resulting from your use of the platform.

11. Indemnity

You agree to indemnify and hold harmless Tabely, its owners, and affiliates from any claims, damages, or legal fees arising from your use of the service or violation of these Terms.

12. Changes to Terms

We reserve the right to update or revise these Terms at any time. Changes will be posted on this page, and your continued use of Tabely constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be resolved in Nigerian courts.
